[Archived in Entry, Open Source Dvd Player]
bstandal on 2004/01/07:
„The objective is to encourage others to further develop the programs. In the autumn 1999 there were no DVD player available under this operating system, and a licence from DVD CCA could not be obtained due to the philosophy of open source code.“

Some slightly related:
„The autumn of 1999 Jon Lech Johansen (“DVD Jon”) with others decrypted the copy control system on DVD records to make it possible to view the DVDs at the Linux operating system. The program that made this possible was called “DeCSS” and released on the Internet. This resulted in him being sued by DVD Copy Control Association in USA, arrested by Norwegian police and charged by The Norwegian National Authority for Investigation and Prosecution of Economic and Environmental Crime (ØKOKRIM).“http://efn.no/jonjohansen-en.html - Cached - Similar Pages

„The Norwegian appeals court upheld a January 2003 ruling from an Oslo City Court acquitting Johansen on all counts and rejecting the prosecutor’s theory that Johansen was guilty of violating Norwegian Criminal Code Section 145.2, which outlaws breaking into digital data that one has no right to access. Because Johansen accessed his own DVD and did not commit any copyright infringement the city court found Johansen innocent on all counts.“http://www.netpolicy.com/dnrc/archives/ cat_misc.html - Cached - Similar Pages
„The decision was in large part based upon the finding that the encryption algorithm affected by DeCSS had lost its "trade secret" status due to extensive publication of DeCSS over the Internet to "a worldwide audience ready and waiting to download and repost it." „It was the MPA and DVD CCA that originally reported Johansen to Økokrim back in January 2000. In the attempt to protect intellectual rights, both of the right holder and of the publishers of copyrighted works, the CSS is imbedded into the DVD and into the hardware used to play the DVDs (-the DVD-players in your sitting room or on your computer). The DVD CCA justify their methods by claiming that while the film is being played in its decoded state – it is easy to copy.“http://huminf.uib.no/~st04555/jottings/archive/ 000014.html - Cached - Similar Pages

„The DVD CCA argumentbelow that violation of a "click license" agreement prohibitingreverse engineering constituted the improper means does not appear tohave merit. To be sure, contract plays an important role in tradesecret law by protecting the trade secret holder against "unauthorizeduse or disclosure through a contract with the recipient of adisclosure" or others who have had special access to trade secretinformation, via confidentiality agreements and the like. Butnowhere has it been recognized that a party wishing to protectproprietary information may employ a consumer form contract to, ineffect, change the statutory definition of "improper means" undertrade secret law to include reverse engineering, so that an allegedtrade secret holder may bring an action even against a nonparty tothat contract.“http://sethf.com/infothought/blog/archives/ 000396.html - Cached - Similar Pages
